10. Liability and Indemnity
10.1. Disclaimer of Warranties
All information and Reports on Carjudge.com are provided for informational purposes only. While we strive for accuracy, Carjudge.com makes no guarantees regarding the completeness, accuracy, or reliability of the data. In no way do we provide warranties of any kind, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Services are provided "as is" and "as available." Your jurisdiction may not allow the exclusion of implied warranties. There are also no warranties provided for any vehicle for which information is listed or that we may transmit to you. This includes any information that may be contained in the Report, vehicle history, auto auction records, repair history, or other report, or from either our VIN decode service or vehicle recalls check service. We do not endorse, certify, authorize, authenticate, or otherwise make any representation regarding the accuracy, timeliness, or completeness of any vehicle, vehicle ownership document, or vehicle registration document that you may be provided via any of our services or that a third-party supplier may send you. Other collected information may not accurately reflect vehicle history, including whether a vehicle was junked, salvaged, dismantled, rebuilt, reconstructed, damaged or tampered with in any way. CarJudge is not liable for any damages resulting from the use of, or non-use of, this information. You assume the risk in relying on any Report when making a vehicle purchasing decision.
10.2. User Responsibility
You are solely responsible for verifying the accuracy and relevance of the information before making any decisions ( e.g., buying, selling, renting, or leasing vehicles). The Reports should not be used as the sole basis for decision-making; consult professional advisors or relevant authorities if necessary.
10.3. Risk Acknowledgement & Limitation of Liability
By using Carjudge.com, you acknowledge that any reliance on the provided information is at your own risk. Carjudge.com, its affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages---including financial losses, lost opportunities, or lost profits---arising from actions or transactions based on the information provided. This limitation applies even if Carjudge.com has been advised of the possibility of such damages and to the fullest extent permitted by law. Reports reflect information from a vehicle's previous sales records, price analytics, condition reports, and odometer readings when sold through auctions and classified websites. CarJudge is not liable for any damages resulting from the use or non-use of this information. Use of any CarJudge vehicle history Report is at your own risk.
11. Last Updated

Subscribers will retain their current subscription terms, including pricing, renewal schedules, and features, unless explicitly notified otherwise.
For any concerns or to initiate a cancellation in response to an ownership change, subscribers should contact support at contact@carjudge.com.
13. Dispute Resolution and Class Action Waiver
13.1. Dispute Resolution; Governing Law; Jurisdiction and Venue.
MANDATORY BINDING INDIVIDUAL ARBITRATION INSTEAD OF COURT; CLASS ACTION WAIVER.
1. You and CarJudge both agree that any and all disputes or claims arising out of or relating in any way to any Services, or from any advertising for any such Services, including any question regarding the existence, validity, or termination of these Terms of Use, as well as any issue regarding the interpretation of this Section, will be resolved by binding arbitration before a sole arbitrator, rather than in court, except that you may assert claims in small claims court if your claims qualify and CarJudge may pursue a collection action against you in court. This also includes any claims that arose before you accepted these Terms of Use, regardless of whether prior versions of the Terms of Use required arbitration. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) and federal arbitration law apply to this arbitration agreement.
2. Arbitration uses a neutral arbitrator instead of a judge and jury. An arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow the terms of these Terms of Use as a court would. Arbitration procedures allow for more limited discovery, and court review of an arbitration award is limited.
3. If you have a dispute and elect to seek arbitration or file a claim in small claims court, you must first send to CarJudge, by certified mail, a written notice of your claim that (a) describes the nature and basis of the claim or dispute; (b) sets forth the specific relief sought and (c) includes a physical address and email address where you may be reached ("Notice"). The Notice must be addressed to: General Counsel, CarJudge, Inc., 5860 Trinity Parkway, Suite 600, Centreville, VA 20120 ("Notice Address"). If CarJudge and you do not reach an agreement to resolve the claim within 60 days after the Notice is received, you or CarJudge may commence an arbitration proceeding or file a claim in small claims court. You may download or copy a form to initiate arbitration at www.adr.org.
4. The arbitration will be governed by the AAA's then current Consumer Arbitration Rules, as modified by these Terms of Use, and will be administered by the AAA. The AAA Rules and Forms are available online at www.adr.org or by calling the AAA at 1-800-778-7879. In the event of any conflict between these Terms of Use and the AAA Consumer Arbitration Rules, the Terms of Use will apply.
5. If your claim totals less than US$25,000, CarJudge will pay for all filing, administrative and arbitration fees, including the arbitrator's compensation, and will reimburse you for any filing, administrative and arbitration fees that you incur. If your claim exceeds US$25,000, you will be responsible for the filing fees and the parties will pay equal shares of any administrative and arbitration fees, including the arbitrator's compensation, except for such fees that the AAA Consumer Arbitration Rules require CarJudge to pay in full. Each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at any arbitration hearing.
6. If your claim is for US$25,000 or less, you and CarJudge agree that you may choose whether the arbitration will be conducted solely on the basis of documents or through a telephonic hearing. If your claim exceeds US$25,000, the right to a hearing will be determined by the arbitrator.
7. You and CarJudge agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, representative, consolidated or mass action. You shall not join or consolidate claims or arbitrate or otherwise participate in any claim as a class representative, class member or in a private attorney general capacity. If this provision is found to be unenforceable, then the entirety of this Section shall be null and void.
8. Any arbitration will be confidential. Neither you, CarJudge, the AAA nor the arbitrator may disclose the existence, content (including any oral or written submissions), or results of any arbitration, except as may be required by law or for purposes of enforcing or challenging of the arbitration award.
9. You may opt out of this dispute resolution procedure by providing written notice to CarJudge at the Notice Address no later than 30 calendar days from the date of your purchase of the applicable CarJudge Services (or date of first use, in the case of free Services). Such opt out will apply only to any Services that you purchased or used and which you specifically identify in the notice; provided, however, it will not apply either retroactively or prospectively to any other Services. If you purchase or use additional CarJudge Services in the future and wish to opt out of this dispute resolution procedure for those Services, you will have to submit a new written notice. Opting out of this dispute resolution procedure will not otherwise affect the coverage or applicability of these Terms of Use, or your ability to purchase or use Services, in any way.
Governing Law
By establishing a CarJudge account or purchasing or using any Services, you agree that the Federal Arbitration Act, applicable federal law, and laws of the State of New York, without regard to its conflict of laws rules, including, but not limited to, the Uniform Computer Information Transactions Act ("UCITA"), will govern these Terms and Conditions, as well as any dispute of any sort that might arise between you and CarJudge.
Jurisdiction and Venue
If for any reason a claim proceeds in court rather than in arbitration or small claims court, we each waive any right to a jury trial and agree that any such proceeding shall be conducted only on an individual basis and not in a class, representative, consolidated or mass action. Under such circumstances, except for a collection action by CarJudge, you and CarJudge agree that jurisdiction and venue for all matters relating to these Terms of Use shall be vested exclusively in the state or federal courts in New York, NY.
